East Fork Salmon River Water Grab

Snake River Basin Adjudication subcases 72-16778 et seq.
Date Filed:

In these 12 related SRBA subcases, we represent a conservationist water right holder opposing a "water grab" ploy by irrigators in the East Fork Salmon River watershed, which is critical habitat for salmon, steelhead, and bull trout.

The East Fork irrigators have submitted motions to file "late" water right claims in the SRBA, which seek about five times the amount of water to which they have already obtained decreed rights in the SRBA.  The irrigators claim that they need these additional water rights for "conveyance losses" in the form of seepage and evaporation from their irrigation ditches.  Because their water rights have already been determined, and the amounts of losses they claim are unreasonable and wasteful, there is no legal basis for them to now vastly inflate the amount of their water rights.
